By accessing or using our website, products, or services, you agree to be bound by the following Terms & Conditions. Please read them carefully.
Arrival: Decorating Staff will arrive onsite as specified by the client. We cannot be held
responsible for delays (or incomplete décor) if not allowed a reasonable amount of time to
complete décor services as described in the agreement.
Terms: Payments may be made by Cash, Venmo or Zelle.
- A 50% retainer is required to secure the decorating services as outlined in
the agreement. These funds are scheduled to be collected on the signing of the
contract.
- The balance of the payment is due the 2 days before service
We hereby propose to furnish labor and materials, complete in accordance with the agreement
specifications.
Material Guarantee:
All materials are guaranteed to be as specified by the manufacturer. If a supplier discontinues a
product or the manufacturer changes material type, M&M Balloons reserves the right to make
any last-minute changes (at our discretion based on availability of materials at time of event).
We reserve the right to substitute an item of like kind and quality.
Accident Clause:
We are not responsible for accidents or injuries related to our decor that are caused by mischief
or mishandling by the client, guests, or site staff. Please, do not allow guests to put the latex
balloons into their mouths. Be aware that some Children and Adults have allergic reactions
to latex. These Children/Adults should refrain from having contact with the latex
balloons.
Inclement Weather Clause: M&M Balloons shall not be responsible should weather conditions
make it impossible to perform décor service (as described in the agreement). This includes (but
is not limited to) strong winds, rain or SNOWSTORMS. However, if inclement weather prevents
installation of agreed décor, A FULL REFUND MINUS DEPOSIT WILL BE ISSUED
PROMPTLY.
Outdoor Décor Clause: We use only the highest quality products and make every possible
effort to ensure that your décor will meet or exceed your expectations. However, due to the
general nature of balloons, we cannot guarantee that your balloons will remain perfect and
intact when used outdoors. If inclement weather conditions, make it difficult or impossible to
produce as specified M&M Balloons will do its best to be flexible with providing décor
alternatives. It is clearly understood that there will be no refunds or discounts for loss,
breakage, or failure to produce due to factors outside and beyond our control.
Payment: Final payment may be made by cash, Zelle or Venmo. Final payment must be
received at the time indicated above to assure fulfillment of this agreement. Once the final
payment has been made, there will be no refunds. M&M Balloons is not responsible for
inclement weather, acts of God, or other situations that may cancel or postpone your event.
Please note that we will make every effort to accommodate date changes to your event.
Photography:
Photos or videos of our work may be taken for promotional use and advertising purposes on our
website, portfolio, social media, brochure, etc. You agree to us taking and using such images as
described and release all claims regarding use.
The signed agreement serves as a release authorization for such materials.
Cancellation:
PLEASE CAREFULLY CONSIDER THE CANCELLATION TERMS BEFORE COMMITTING
In the event of a cancellation, M&M Balloons retains the right to apply fees as follows:
- For cancellations within 24 hours of event – 100% of retainer will be applied (to cover expenses incurred for preparation of event, which includes but is not limited to: cost of materials, operating cost & lost wages.
All cancellation requests must be made in writing and postmarked within the guidelines of this
agreement.
We reserve the right to update or modify these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date.
